On 14 August 1991, Law no. was approved by Parliament. 281 - Law framework relating to animals affection and prevention of stray dogs. The law represented an element of strong innovation compared to the previous national legislation. Among the innovations introduced by Law 281/91 there is the prohibition (Article 2, paragraph 2) of the suppression of wandering dogs caught or otherwise hospitalized or detained in health kennels as until then established by the "Veterinary Police Regulations" (RPV) - Presidential Decree no. 320 of 8 February 1954. The so-called "no kill" principle introduced by law 281 has represented a unique prerogative of our country for many years. Recently other countries have also adopted the suppression ban or have bills under discussion for its adoption. Article 281 of Law 91/8 provides for the establishment, within the Ministry of Health, of a fund for its implementation starting from 1991.
The Minister, with his own decree, annually divides the availability of this fund between the regions and autonomous provinces of Trento and Bolzano. The Law also provides for the identification of dogs and the establishment of a canine registry at local level. The Agreement of 6 February 2003 between the Ministry of Health, the regions and the autonomous provinces of Trento and Bolzano "on the subject of pet welfare and pet therapy", in order to reduce the phenomenon of stray dogs, has envisaged a series of measures such as: the introduction of the microchip as the only official dog identification system, starting from 1 January 2005; the creation of a computerized database, on regional or provincial base; the activation of a national database established at the Ministry of Health (National Canine Registry), which brings together the data from the regional registries. This national system allows the return of lost animals to the owner, the monitoring of the dog population and the issuing of passports, thus helping to reduce stray dogs and prevent the phenomenon of abandonment. Law 189 of 20 July 2004 - "Provisions concerning the prohibition of mistreatment of animals, as well as their use in clandestine fights or unauthorized competitions". Law 189/2004 makes changes to the penal code and in particular introduces, with title IX bis, "crimes against feelings for animals". In particular, the crimes of killing animals, mistreatment of animals and fighting between animals are regulated. Furthermore, article 727 of the penal code has been replaced with the following: (Abandonment of animals) - Anyone who abandons domestic animals or animals that have acquired habits of captivity is punished with imprisonment for up to one year or with a fine of 1.000 to 10.000 euros. Anyone who keeps animals in conditions incompatible with their nature and resulting in serious suffering is subject to the same penalty. With law 189/2004, Italy, the first country in Europe, has established a ban on the use of skins and furs for commercial purposes. of dogs (Canis familiaris) and cats (Felis catus).
